1. Scope and acceptance
These Terms of Use (the “Terms”) govern your use of the beQ mobile application and related services provided by beQ AG (“beQ”, “we”, “us” or “our”). By creating an account, accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. The Services
beQ provides a platform that may enable users to create and manage profiles, discover people, businesses and events, communicate through private and group chats, create or join events, create business profiles, submit or respond to reviews, manage connections and favourites, and use privacy and visibility settings.
3. Accounts and responsibilities
You must provide accurate information, keep your account credentials confidential and use the Services lawfully. You are responsible for activity carried out through your account unless it results from unauthorised access that is not attributable to you.
4. User content
You remain responsible for content you create, upload, publish, send, share or otherwise make available through beQ, including profile information, photos, videos, events, business content, reviews, messages and attachments (“User Content”). You confirm that you have the rights required to provide User Content and that it does not violate another person’s rights or applicable law.
To operate the Services, you grant beQ a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, adapt, display, distribute and communicate User Content to the extent necessary to provide, maintain, secure and improve the Services, subject to your privacy and visibility settings and applicable law.
5. Acceptable use
- Violate applicable law, regulation or third-party rights
- Harass, threaten, stalk, intimidate, exploit or impersonate another person
- Publish unlawful, hateful, discriminatory, sexually exploitative, defamatory, fraudulent or harmful content
- Share another person’s personal data without a lawful basis or appropriate permission
- Send spam, malware, phishing content or deceptive messages
- Scrape, harvest, copy, crawl, reverse engineer, interfere with or overload the Services except where expressly allowed by law
- Circumvent security measures, moderation actions or feature restrictions
- Create misleading businesses, events, profiles or reviews
6. Child safety
beQ has zero tolerance for CSAE and CSAM. You must not use the Services to create, upload, request, store, share, distribute, link to, promote or facilitate CSAM, grooming, sextortion, trafficking of a child for sexual exploitation, sexualisation of a minor, or any other conduct that sexually exploits, abuses, endangers or targets a child or minor.
Violation of this rule may result in immediate content removal, account restriction or permanent termination, preservation of relevant information, and reporting to competent authorities where required or appropriate under applicable law. See our Child Safety Standards.
7. Safety and interactions
beQ provides tools that may help users manage visibility, location sharing, connections, reporting and blocking. You remain responsible for using good judgment when interacting with other users, attending events, communicating or sharing information.
beQ does not conduct background checks on every user and does not guarantee the identity, conduct, availability, safety, legality or accuracy of users, businesses, events or User Content. If there is an immediate risk, contact the relevant emergency services.
8. Events, businesses and reviews
Users who create or manage events or businesses are responsible for their accuracy, legality, permissions, safety and operation. beQ is not a party to arrangements, transactions, disputes or interactions between users, businesses, organisers or participants unless expressly stated in a separate written agreement.
Reviews must reflect genuine experiences and must not be fabricated, purchased, manipulated or used to harass or defame others.
9. Moderation and enforcement
We may review, investigate, remove, restrict, preserve or disclose User Content or accounts where reasonably necessary to protect users, enforce these Terms, comply with law, respond to reports or protect the Services. We may suspend or terminate access when we reasonably believe these Terms have been violated or where required by law.
10. Intellectual property
The beQ name, logo, software, design, text, graphics and other beQ-provided materials are owned by or licensed to beQ and protected by applicable intellectual-property laws. Apart from the limited right to use the Services under these Terms, no rights are granted to you.
11. Availability and changes
We may modify, suspend or discontinue all or part of the Services at any time, subject to applicable law. We do not guarantee that the Services will always be available, uninterrupted, secure or error-free.
12. Disclaimers and liability
The Services are provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law. beQ does not guarantee that content, users, listings, events, messages, matches, routes, locations or other information will be accurate, complete, reliable, safe, lawful or suitable for your purposes.
To the maximum extent permitted by applicable law, beQ is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill, opportunity or business interruption arising from or connected with the Services. Nothing in these Terms limits or excludes liability where limitation or exclusion is prohibited by applicable law.
13. Termination and deletion
You may stop using the Services at any time. You may request account deletion as described in our Privacy Policy and Account Deletion page.
14. Governing law
These Terms are governed by the laws of Liechtenstein, excluding conflict-of-law rules, unless mandatory consumer-protection law requires otherwise. Consumers may benefit from mandatory provisions of the law of their country of habitual residence.
15. Changes and contact
